Terms

Terms of use

These terms apply to the Framebird iPhone app and the Framebird desktop app for Windows (together, “Framebird”), published by Sajad Shafi under the name BirdsCode (“we”, “us”). By installing or using Framebird, you agree to them. If you don’t agree, please don’t use Framebird.

1. Your license

Framebird is free. We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use Framebird on devices you own or control, for personal or commercial purposes, under these terms.

You may not:

  • sell, rent, sublicense or redistribute Framebird, or offer it as part of a paid service;
  • reverse engineer, decompile or modify the apps, except where the law allows it despite this restriction;
  • remove or alter any copyright, trademark or other notices;
  • use Framebird to break the law or infringe anyone’s rights.

Framebird, its name, logo and code remain our property. These terms don’t transfer any ownership to you.

2. Using Framebird responsibly

You’re responsible for what you capture and share with Framebird. In particular:

  • get the consent of people you film or broadcast where the law requires it;
  • follow the terms of the calling, streaming and recording apps you use Framebird with;
  • use only networks and devices you’re allowed to use.

3. App stores

If you got Framebird from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies. Apple isn’t responsible for Framebird or its support. If you got Framebird from the Microsoft Store, the Microsoft Store terms also apply. Where these terms and an app store’s terms conflict, the app store’s terms apply for that store’s version.

4. Privacy

How Framebird handles data is described in the privacy policy. In short: video goes directly between your own devices, and we don’t collect personal data.

5. Updates and availability

We may update Framebird to fix problems, improve it or keep it compatible with new operating systems, and we may change or remove features. We may also stop offering Framebird. Because it’s free, we don’t promise that any particular feature, device or app will keep working, or that Framebird will remain available.

Some versions may be marked as previews. Previews may be incomplete or unstable.

6. No warranty

Framebird is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that it will be uninterrupted, error-free or compatible with every device, network or app.

7. Limitation of liability

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or business opportunities, arising from your use of Framebird or inability to use it. Our total liability for any claim relating to Framebird is limited to the amount you paid for it, which is zero.

Some places don’t allow certain warranty exclusions or liability limits. In those places, the exclusions and limits above apply as far as the law permits, and nothing in these terms limits rights you have as a consumer that can’t be waived.

8. Ending these terms

You can stop using Framebird at any time by uninstalling it. If you breach these terms, your license ends automatically. Sections 6, 7 and 9 continue to apply after the terms end.

9. Governing law

These terms are governed by the laws of India, without regard to its conflict-of-law rules. If you’re a consumer, you also keep the protection of mandatory laws in the country where you live.

10. Changes to these terms

We may update these terms, for example when Framebird changes. We’ll post the new version here with a new date. Continuing to use Framebird after a change means you accept the updated terms.
